What Should You Do If You Get In A Car Accident Out Of State?

An accident is complicated enough as it is; however, an out-of-state accident can bring additional complications due to different rules pertaining to insurance. Even if you have an insurance cover, you may find that there are slight differences in how you can approach the claims when you're driving in a state in which you're not a resident.

However, despite the small differences, you'll also realize that the system you'll be dealing with is familiar, and you should be relatively okay as long as you have an insurance cover.

What to Do Immediately After the Accident?

When you're involved in an accident, whether it's in your home state or another, there are certain steps that it's always advisable to take. They include the following:

  • Calling the police

  • Seeking medical care

  • Photographing the scene of the accident

  • Getting names and contact details of witnesses

  • Getting in touch with your insurance company

Additionally, you should also not admit fault at any point during the process. A car accident is usually the culmination of a series of events, some of which may not be under your control.

How to Report the Insurance Claim

If you're driving within the US, you'll find that a typical auto insurance cover extends to all parts of the country. The coverage also extends to Canada and Canadian territories. Therefore, you should still be able to be covered by your insurance provider in the matter that is defined in your policy.

This means that there should be no additional complications in reporting a claim to your insurance company even if the accident took place out of town. You can decide to have your vehicle repaired back home or at a repair shop that is much closer to the scene of the accident.

Filing an Injury Claim

In case you or someone else in the car was injured, you'll need to follow the laws of the state in which the car accident took place.

Unfortunately, this is where things can get a little challenging. States have specific conditions and limitations that can affect your claim positively or negatively. For example, you may be in a state that has lower liability limits than your home state. This will lower the maximum amount that the insurance company has to pay you. Depending on the extent of your injuries, this could be a very big problem.

However, you could also be in a state where the opposite is true, so you'll be entitled to a higher claim.
